Disney disputes wrongful death suit over streaming subscription clause

Disney is attempting to get a wrongful death case thrown out on the basis of the smallprint in a Disney+ subscription.

Kanokporn Tangsuan died in October 2023 from a severe allergic reaction after eating at a restaurant in Walt Disney World in Florida.

After her husband, Jeffrey Piccolo, filed a lawsuit, Disney lawyers responded by arguing that because he had signed up for a Disney+ free trial in 2019, he had agreed to settle any legal dispute through arbitration.

Disney also claims to have no connection with the case because it neither owns nor operates the restaurant, an Irish-themed pub called Raglan Road.

So it seeks legal protection from a Disney+ contract while claiming legal immunity by washing its hands of the Raglan Road (even though it sits on Disney property).

Piccolo seeks $50,000 plus costs. The Disney World resort makes on average $20 million dollars a day.
